
Mediation
Mediation aims to help you resolve matters arising from separation and divorce, including children and finances and cohabitation issues.
An independent mediator's role is to facilitate discussions between you. They will help you identify the necessary information to enable you to make informed decisions; and generate settlement options, as well as reality test those options to identify the best solution for you within the individual circumstances of your family.
If you agree a proposal, the mediator can draw this up in a 'Memorandum of Understanding', which your individual lawyers can convert into a court order by consent.
If appropriate, your lawyers can be involved in the mediation (Hybrid Mediation) as well as other independent neutrals to assist with emotional, financial or parenting issues (typically Family Consultants and Financial Experts). If parents and their children would like the children to have a voice, they can be included in 'Child Inclusive Mediation'. Mediation can be done online or round the table.
Mediation is about looking forward and not back, finding solutions and avoiding destructive confrontation.
